Zwight Terms & Conditions

These Terms & Conditions (“Terms”, “Agreement”) govern your use of the Zwight mobile application, website, and all services provided by Zwight Private Limited (“Zwight”, “we”, “us”, “our”). By accessing or using Zwight’s platform (the “Platform”), you agree to be bound by these Terms. If you do not agree, please do not use the Platform.


1. Definitions

User / Customer: any person who registers, places orders, or uses the Platform in any way.

Account: your registered user account on Zwight.

Service(s): the service of ordering, delivery, or other offerings made available via Zwight.

Delivery Partner: third-party persons/companies who fulfil deliveries.

Seller / Merchant: restaurants or food / beverage providers listing on Zwight.

Order: purchase request made by User via the Platform.

Promotions / Offers: any discount, coupon, or incentive provided by Zwight.


2. Acceptance of Terms

  1. These Terms are a legally binding contract between you and Zwight.
  2. By creating an Account, placing Orders, or accessing any part of the Platform, you accept and agree to all Terms (including any changes made from time to time).
  3. Zwight may modify these Terms (including policies, fees, features) at any time. Latest version will be published on the Platform. Continued use after modifications constitutes acceptance.

3. Eligibility

  • You must be at least 16 years old to use our services. If under 18, you may use only under parental or guardian consent.
  • You must provide accurate, current and complete information when registering and maintain that information.
  • You must have legal capacity to enter into contracts.

4. Registration & Account Security

  • To use certain features (placing an order, payment etc.), you need to register an account. Registration requires valid mobile number, email, or other information as required.
  • You are responsible for maintaining confidentiality of login credentials. Zwight is not responsible for any unauthorized use resulting from your failure to maintain security.
  • Zwight may suspend or terminate your account if any information is false, misleading, or you violate these Terms.

5. Use of Platform

  • Zwight works as a facilitator. We connect you with restaurants, merchants, delivery partners. Zwight does not manufacture goods.
  • Zwight may, in its discretion, refuse or cancel Orders, limit quantities, or impose restrictions on certain promotions.
  • You agree to use the Platform lawfully. You will not misuse it, impersonate others, interfere with the service, upload harmful code, or attempt unauthorized access.

6. Orders, Order Acceptance & Modifications

  • When you place an Order, it is subject to acceptance by Zwight / the Merchant. Once accepted, Zwight will start processing.
  • Zwight may reject an order for e.g. unavailability, merchant inability, location issues, payment issues.
  • You may be allowed to modify or cancel orders before certain stages (before preparation/preparation start). Once preparation begins (as per merchant’s workflow or Zwight’s indication), modifications or cancellations may not be possible, or may incur charges.

7. Pricing, Payment & Fees

  • Prices displayed include applicable taxes unless otherwise stated. However, additional fees may be charged: delivery fees, service fees, surge/rain fees if applicable, packaging charges etc.
  • Payment can be via supported gateways (credit/debit card, UPI, wallet, cash-on-delivery if enabled).
  • Zwight reserves the right to add, modify or remove fees, and change payment methods.
  • If payment fails, Zwight reserves right to cancel the Order.

8. Delivery & Time Promise (e.g. 15 Minutes or Free)

  • Zwight aims to deliver within 15 minutes of order confirmation (unless otherwise promised).
  • Time begins when Zwight’s system confirms the order (acceptance point), not when you press “Place Order”.
  • Delays due to events beyond our control (traffic, weather, public holidays, force majeure) are excluded from this promise.
  • If Zwight fails to deliver within promised time under qualifying conditions, you may be eligible for compensation/free order or refund under Zwight’s policy. Zwight reserves right to define qualifying conditions and exclusions.

9. Cancellations & Refunds

  • You can cancel an order subject to merchant status. If cancelled before preparation begins, full or partial refund as per policy. If cancelled later, partial/no refund may apply.
  • In case of missing, damaged, wrong items, or quality issues, you must report to Zwight via connect@zwight.in with relevant details (order number, photos, description). Zwight may investigate and decide remedy: replacement, refund, or credit.
  • Refunds (if any) will be processed within a specified time (e.g., 7–10 business days) to the original payment method.

10. Promotions, Coupons & Offers

  • Promotions are subject to eligibility, limited supply, validity period, and may have minimum order value or other conditions.
  • Coupons/offers are non-transferable and cannot be exchanged for cash.
  • Zwight may modify, suspend, or cancel offers at any time without prior notice.
  • Misuse or abuse of offers (e.g. using multiple accounts, fraudulent redemption) may lead to cancellation of Orders, suspension of account, or legal action.

11. Product Information & Allergens

  • Zwight strives to maintain accurate product descriptions, photos, prices, nutritional/allergen information. However, actual products may vary slightly.
  • Users must inform merchants of any known allergies before ordering. Zwight will not be liable for any allergic reactions or health issues from consuming the products.

12. Intellectual Property

  • All content on the Platform (logos, images, text, trademarks, software etc.) is owned or licensed by Zwight. You may not copy, reproduce, publish, or distribute without written permission.
  • You grant Zwight a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt any feedback or content you provide (reviews, suggestions) for improving services and for marketing.

13. User Conduct & Prohibited Activities

You agree not to:

  • Use the Platform for any unlawful or unauthorized purpose.
  • Submit false, inaccurate, defamatory, or misleading information.
  • Impersonate someone else or misrepresent your affiliation.
  • Disrupt or attempt to gain unauthorized access to the services, other accounts, systems or networks.
  • Use abusive, profane, or offensive language in communications with Zwight or other users, merchants or delivery partners.
  • Engage in sending unsolicited promotions, spam, chain letters, etc.

Zwight reserves right to suspend or terminate accounts for misconduct.


14. Reviews, Ratings & Feedback

  • Users may provide reviews/ratings of merchants, products, delivery experience. Zwight may moderate or remove content that violates policies (defamatory, false, illegal).
  • By submitting such content, you represent it is your own and you have necessary rights. Zwight has right to use it (as above).

15. Data Privacy & Security

  • Zwight will collect, process and store personal information as per our Privacy Policy. We use standard security measures to protect data.
  • Zwight may share data with third parties only for specified purposes: payment processing, order fulfilment (merchants, delivery partners), legal compliance, marketing (if you consent).
  • Zwight will handle your data in compliance with applicable laws (Information Technology Act, data protection rules, etc.).

16. Third-Party Services & Content

  • Zwight may include links to third-party sites, products or services. Zwight is not responsible for the conduct, content, or performance of third-party offerings.
  • Payment gateways, logistics providers, etc., are third parties. Zwight is not liable for delays, faults, or failures caused by them except as per applicable contract.

17. Liability, Disclaimers & Indemnification

  • Zwight provides services on “as-is” and “as available” basis. Zwight does not guarantee uninterrupted, error-free service.
  • Zwight is not liable for indirect, incidental, special, consequential or punitive damages arising out of your use or inability to use Platform. This includes loss of profits, loss of data, etc.
  • Zwight’s total liability for any claim arising out of an order or service will not exceed the amount paid by you for that order.
  • You agree to indemnify, defend and hold harmless Zwight, its affiliates, officers, employees, delivery partners, merchants from and against any claim, demand, loss or damage (including legal fees) arising from: your use of the Platform, your breach of Terms, your violation of laws, or your infringement of another’s rights.

18. Force Majeure

  • Zwight will not be responsible for failure or delay in performance resulting from circumstances beyond our control, including but not limited to natural disasters, war, terrorism, strikes, government orders, or failure of telecommunications or infrastructure.

19. Suspension & Termination

  • Zwight may suspend or terminate your account or access to services at any time, without notice, for breach of Terms, fraud, misuse, or legal reasons.
  • Termination does not affect rights or obligations that arose before termination (e.g. pending payments, outstanding liability).

20. Dispute Resolution & Jurisdiction

  • If any dispute arises between you and Zwight in connection with these Terms, both parties will try to resolve amicably by contacting each other (you via connect@zwight.in).
  • If not resolved within 30 days, the dispute shall be subject to the courts having jurisdiction in Shahjahanpur, Uttar Pradesh or Lucknow, Uttar Pradesh (Zwight may specify whether both are options or only one, depending on registered office).
  • These Terms are governed by the laws of India.

21. Miscellaneous

  • Severability: If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect.
  • Waiver: Delay or failure to enforce any right under these Terms does not constitute a waiver.
  • Assignment: Zwight may assign or transfer rights and obligations under these Terms. You may not assign without Zwight’s prior written consent.
  • Notices: Communications may be sent via email, or via Platform notifications. Notice to Zwight: to connect@zwight.in.
